What was the Fairness Doctrine?

"The fairness doctrine helped reinforce a politics of moderation and inclusiveness. The collapse of the fairness doctrine and its corollary rules blurred the distinctions between news, political advocacy, and political advertising, and helped lead to the polarizing cacophony of strident talking heads that we have today."
-State Rep. Mark B. Cohen of Philadelphia

A license permits broadcasting, but the licensee has no constitutional right to be the one who holds the license or to monopolize a...frequency to the exclusion of his fellow citizens. There is nothing in the First Amendment which prevents the Government from requiring a licensee to share his frequency with others.... It is the right of the viewers and listeners, not the right of the broadcasters, which is paramount.
— U.S. Supreme Court, upholding the constitutionality of the Fairness Doctrine in Red Lion Broadcasting Co. v. FCC, 1969.

What happened to the Fairness Doctrine?

The Reagan Administration, which has always opposed the Fairness Doctrine, with the help of the Washington D.C. Court of Appeals, with Judge Robert Bork on the bench, along with then Judge Antonin Scalia were able to find a case to bring before the Supreme Court to doom the Fairness Doctrine. In August 1987 the FCC repealed the Doctrine.

The Doctrine was never a law -- it existed for 38 years as a policy of the FCC. Congress overwhelmingly passed a bill to turn the Fairness Doctrine into law. President Reagan vetoed it.

What do you do when you hear foul language on television? As for me, sometimes I cringe, sometimes I don't. Sometimes I'm surprised, sometimes disappointed, and sometimes the words just come and go without much effect.

The police are using this ancient concept to tackle urban gangs, but can it be fairly administered? The centuries-old legal doctrine of "joint enterprise" has been taken up with enthusiasm by modern policemen and prosecutors. It provides one remedy for the increasingly intractable problem of how you prosecute urban gangs. However, its increased use also raises very real issues of fairness, as ...

It's not a stretch to say that the Iowa Republican Party feels enmity for President Obama. Their recently-adopted party platform includes a "birther" plank, as well as one calling to "restore" the original 13th Amendment of the Constitution for the sole apparent purpose of using its byzantine language to strip Obama of his Nobel Peace Prize.

This bill represents another attempt by my colleagues to rush through legislation that restricts freedom and creates more federal regulation, without giving the American people the opportunity to understand what it does, Sen. Cornyn said.
